By accessing or using our website, app, services, or tools (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). 10. Limitation of Liability

To the max extent allowed by law, ActionTaker (and our team, affiliates, etc.) isn't liable for any indirect, incidental, or consequential damages from your use of the Service— The Service is "as is," with no warranties. If something goes wrong, our liability won't exceed 5 cents. Some states don't allow these limits, so you might have extra rights.

11. Indemnification

You agree to defend and hold us harmless from any third-party claims, damages, or costs (including legal fees) arising from your use of the Service, violation of these Terms, or disputes with other users. Basically, don't make us clean up your mess!

12. Termination

We can suspend or boot you from the Service without notice if you break these Terms or for any reason (or no reason). You can terminate your account by emailing us at team@actiontaker.com. Some terms, like liability limits and IP rights, survive termination—because legal stuff is sticky like that.

13. Changes to These Terms

We might tweak these Terms as the Service evolves. We'll post the updated Terms on the Service and note the last modification date. Keep an eye out, because using the Service after changes means you're on board with the new Terms.

15. Governing Law and Arbitration

These Terms are governed by the laws of California, San Diego County, without regard to conflict of law rules. Any disputes will be settled through binding arbitration under the Streamlined Arbitration Rules of Judicial Arbitration and Mediation Services, Inc. (JAMS), by a single arbitrator with experience in commercial disputes. Arbitration will happen in San Diego, California, or the U.S. county of your most recent address. The arbitrator's decision can be enforced in any court.

You can seek injunctive relief in court if needed. For all purposes, you consent to exclusive jurisdiction in San Diego's state or federal courts. Arbitration is individual—no class actions or jury trials. By using the Service, you waive your right to a jury trial or class action. Tough but fair, right?

16. Entire Agreement

These Terms, along with our Privacy Policy, are the full deal between you and ActionTaker. They replace any prior agreements, written or oral. No side deals here!
